H-1B CAP REACHED
USCIS announced that the H-1B cap was reached as of petitions submitted by May 26, 2006. Petitions received after that date will be returned. Petitions received on that date will be subject to a random selection process.

USCIS TO ALLOW PREMIUM PROCESSING FOR FORMS I-140, I-765, I-539
The USCIS recently announced that it will soon include I-140s, I-765s, and I-539s in the Premium Processing (PP) program. Under this program, the USCIS will guarantee that an approval or RFE within 15 business days of filing. The charge for the expedited process is $1,000. The USCIS has not yet announced the effective dates for this program.

A CALL TO ACTION: RETROGRESSION
HLG projects that the Schedule A visa allotment -- for Registered Nurses and Physical Therapists -- provided by the May 2005 legislation will end in 4Q 2006 (October-December 2006). HLG is in the process of reinvigorating its Advocacy team from 2004 and 2005. We are actively courting funding pledges.

IELTS ELIMINATES 90 DAY WAIT RE-TAKE RULE
Effective May 1, 2006 the policy on candidates re-taking IELTS has been amended. The restriction on re-taking IELTS within 90 days will be removed and candidates will be able to repeat the test whenever they wish. All candidates from 1 May are able to repeat at the next available test, regardless of the date of their previous test.
